Terms & Conditions

These terms govern your use of the Hikmah Bayu website and your participation in our financial education programmes. Please read them before submitting an enquiry or enrolling.

By submitting an enquiry or enrolling in any Hikmah Bayu programme, you agree to be bound by these Terms & Conditions. If you do not agree, please do not proceed with enrolment.

Definitions

  • "Hikmah Bayu" / "we" / "us" / "our" — refers to Hikmah Bayu, registered and operating from 32 Lebuh Cintra, 10100 George Town, Penang, Malaysia.
  • "Programme" / "Service" — any financial education programme offered by Hikmah Bayu, including The Five-Foot-Way, Reading Statements and Documents Plainly, and Considered Pre-Retirement Engagement.
  • "Participant" / "User" / "you" — any individual who visits our website, submits an enquiry, or enrols in a programme.
  • "Content" — all written materials, worksheets, frameworks, spoken guidance, and digital resources provided as part of a programme.
  • "Agreement" — the contract formed between you and Hikmah Bayu upon confirmation of enrolment.
  • "Website" — the Hikmah Bayu website hosted at hikmahbayu.pro.

Acceptance of Terms

By using the Website or enrolling in a programme, you confirm that you have read, understood, and agree to these Terms & Conditions. You must be at least 18 years of age and legally capable of entering into a binding agreement under Malaysian law.

These Terms apply alongside our Privacy Policy. In the event of inconsistency, the Privacy Policy governs data protection matters and these Terms govern all other aspects of the relationship.

Programme Description

Hikmah Bayu offers financial education programmes designed for adults aged 40 and above who wish to develop a clearer understanding of personal finance, retirement preparation, and financial documentation. Our programmes are delivered in small groups or private mentoring formats, primarily in George Town, Penang.

Programmes are scheduled on a rolling basis. Availability, scheduling, and format are subject to change. We will notify enrolled participants of any material changes with reasonable advance notice.

Enrolment

  • Enrolment is confirmed only upon receipt of written confirmation from Hikmah Bayu and payment of the applicable programme fee.
  • Places are allocated on a first-come, first-served basis. Submission of an enquiry does not constitute a reservation.
  • We reserve the right to decline any enrolment application at our discretion, in which case any fees paid will be refunded in full.
  • For small-group programmes, a minimum number of participants may be required. If a cohort does not reach the minimum, we may defer or reschedule the programme and will provide full refunds if you choose not to transfer.

Participant Responsibilities

As a participant, you agree to:

  • Attend sessions punctually and engage in good faith with the programme content
  • Treat fellow participants, facilitators, and staff with courtesy and respect
  • Not record sessions (audio, video, or otherwise) without prior written consent from Hikmah Bayu
  • Not reproduce, share, or distribute programme materials outside the group without written permission
  • Provide accurate personal information when enquiring or enrolling
  • Notify us promptly if your contact details change during a programme

Hikmah Bayu reserves the right to remove a participant from a programme without refund if their conduct is disruptive, harmful to other participants, or in breach of these terms.

Intellectual Property

All programme content — including written materials, worksheets, frameworks, session structures, and related documentation — is the intellectual property of Hikmah Bayu and is protected under Malaysian copyright law.

Upon enrolment, you are granted a limited, non-exclusive, non-transferable licence to use programme materials for your own personal, non-commercial financial education purposes. This licence does not permit redistribution, resale, adaptation, or teaching from these materials.

Nothing in these Terms transfers ownership of any intellectual property to you.

Payment Terms

  • All fees are quoted and payable in Malaysian Ringgit (RM).
  • Payment is due in full before the commencement of a programme unless a payment plan has been agreed in writing.
  • Accepted payment methods include bank transfer and any other method confirmed by Hikmah Bayu at time of enrolment.

Programme-Specific Terms

The Five-Foot-Way: An Orientation (RM 510)

A 3-week introductory group programme. Places are limited to eight participants per cohort. Attendance at all three sessions is encouraged; no partial-completion certificate is issued. Session schedules are confirmed at least two weeks before the start date.

Reading Statements and Documents Plainly (RM 1,560)

A 6-week small-group programme. Participants are expected to bring actual financial documents (bank statements, EPF statements, insurance policies) to relevant sessions. Documents shared in group settings are treated with strict confidentiality. The group size is capped at six.

Considered Pre-Retirement Engagement (RM 2,690)

A 5-month private, mentor-led programme. An initial discovery session takes place before formal enrolment is confirmed. The programme is tailored to the individual's circumstances. Any materials prepared specifically for the participant remain the intellectual property of Hikmah Bayu but will be provided to the participant for personal use.

Hikmah Bayu provides financial education — not financial advice. Nothing discussed or provided in our programmes constitutes a personalised recommendation to buy, sell, or hold any financial product, nor should it be construed as professional financial, legal, or tax advice.

Participants are encouraged to consult qualified financial planners, accountants, or legal professionals for decisions specific to their circumstances. Programme content reflects general financial literacy principles applicable to the Malaysian context and is provided in good faith.

The Website and its content are provided "as is" without warranty of any kind, including for accuracy, completeness, or fitness for a particular purpose.

Limitation of Liability

To the fullest extent permitted by Malaysian law, Hikmah Bayu shall not be liable for any indirect, incidental, consequential, or special damages arising from your participation in a programme or use of the Website — including but not limited to financial decisions made based on programme content.

Our total liability to you in connection with any programme shall not exceed the fee paid for that programme. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence.

Termination

Either party may terminate enrolment by providing written notice. Participant-initiated cancellations are subject to the refund policy in Section 7. Hikmah Bayu may terminate an enrolment without refund where a participant has materially breached these Terms (see Section 5).

Sections 6 (Intellectual Property), 9 (Disclaimers), 10 (Limitation of Liability), and 12 (Dispute Resolution) survive termination.

Dispute Resolution

These Terms are governed by the laws of Malaysia. Any dispute arising from or in connection with these Terms shall first be referred to good-faith negotiation between the parties. If unresolved after 30 days, disputes shall be submitted to the courts of Penang, Malaysia, which shall have exclusive jurisdiction.

Consumers in Malaysia also have recourse to the Tribunal for Consumer Claims Malaysia (Tribunal Tuntutan Pengguna Malaysia) for claims within the applicable thresholds under the Consumer Protection Act 1999.

General Provisions

  • Entire agreement. These Terms, together with any written enrolment confirmation, constitute the entire agreement between you and Hikmah Bayu relating to the subject matter herein.
  • Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
  • Waiver. Failure to enforce any provision of these Terms shall not constitute a waiver of the right to enforce it in the future.
  • Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights to a successor business.
  • Notices. Notices under these Terms should be sent to [email protected] or by post to our registered address.

Changes to These Terms

We may update these Terms from time to time. The revised version will be posted on this page with an updated effective date. For enrolled participants, material changes will be communicated directly. Continued participation in a programme after the effective date constitutes acceptance of the updated Terms.
